Gov. Gavin Newsom signed Senate Bill 344 into law on Tuesday, clearing Midway Rising’s path to begin construction on a massive redevelopment of the former San Diego Sports Arena.

The plan, to convert the land around the arena into a project with 4,250 housing units, 130,000 square feet of retail, a new 16,000-seat arena and 14.5 acres of park space, has long been challenged by residents citing coastal height limits.

The bill, proposed by State Sen. Akilah Weber Pierson, declares the environmental reports studying the impacts of the redevelopment as sufficient, allowing city officials to grant approval of the project.

The bill states that because the Midway Rising project includes 2,000 affordable units, the environmental review approved by the city is enough and should not be held up by any further litigation.

With the bill now law, the Midway Rising project will soon go before the San Diego City Council for final approval. It also likely ends all legal challenges which thus far have thwarted progress on the redevelopment of the site around Pechanga Arena, as it is now known.

The project, proposed by local developer Brad Termini and his company Zephyr, is mostly owned by billionaire Stan Kroenke, who owns the Los Angeles Rams, the Los Angeles Angels, Arsenal F.C., Colorado Avalanche and Denver Nuggets sports teams.

Kroenke is said to be the largest private landholder in the country.

SB 79 and Budget Cuts in Letters to Editor

Sometimes the truth is more forthright and evident in the Letters to the Editor than in the news articles — or lack of — themselves.(I always check them out in both the U-T and LA Times daily.)

Here’s two from today, Wednesday, Sept. 23, that speak volumes; they both are responding to the news that San Diego’s Metropolitan Transit System may have to make budget cuts that would eliminate over one-third of the current bus routes, force cut backs on another third, and less frequent trolley trains on all four lines. The letters make the case that with drastic, even draconian budget cuts to MTS, the foundational logic for Senate Bill 79 and other pushes for high-density near transit has been lost. Despite this, our politicians are not taking note of these potential heavy-weight changes to our urban landscape.

Let’s say that again, as it’s very important and immediately stands out amid this news.

The grim news of potential major service cuts— including eliminating a third of bus routes and reducing trolley frequency due to projected $100M–$150M deficits by fiscal year 2030—has intensified criticism that building high-density, low-parking housing near transit stops under laws like Senate Bill 79 is losing its foundational logic.

What an eye-opener. After years of the “build, baby build” housing policies of the YIMBYs, Todd Gloria, our City Council and the state Legislature — pushing the building of high-density housing along transit routes — we learn that MTS is going broke and may need to cut back bus routes and trolley service. Yet our politicians keep wanting to build high-density housing with minimal parking requirements.

AB 2576 closes an important gap in California’s new transit-oriented housing law, SB 79. It provides protections for qualifying contributing properties within historic districts listed in the California Historical Resources Inventory Database, as well as individually listed historic resources in the inventory, when designated before January 1, 2025.

Democratic state parties announced Monday that they are launching an operation for the midterm elections they’re calling the “New Battlefield Project,” intended to recruit 10,000 volunteers to guard polling places in case armed federal officers show up.

Activists are planning mass protests if the Trump administration tries to interfere with voting or ballot counting. And legal scholars are distributing white papers advising judges what they should do if the government tries to seize ballots.

The unprecedented efforts are in response to President Donald Trump’s equally unprecedented moves to interfere in this year’s midterm elections, which include attempts to impose proof-of-citizenship requirements to register to vote and directing the Postal Service to play a central role in deciding which voters should get a mail ballot.

The anxious contingency planning as voting gets underway has become a marker for how fraught democracy has become in the country that once stood as an example to the world.

“We have never prepared for an election sabotage event like we have now,” said Ezra Levin of the left-leaning group Indivisible.

In a major win for voters, the Supreme Court Monday rejected the Trump administration’s attempt to reinstate its mail voting restrictions ahead of November’s pivotal midterm elections.

The justices declined to lift a block on the measure that a lower court judge has said is likely unconstitutional.

“The Government is unlikely to succeed on the merits of its challenge to the District Court’s preliminary injunction,” the court said in a brief, unsigned order. “And the equitable factors applicable for obtaining emergency relief from this Court do not favor a stay.”

The ruling* was 6-1-2, with Justice Brett Kavanaugh writing a concurring opinion and Justices Samuel Alito and Clarence Thomas dissenting.

We are less than [three weeks] until Election Day for the most important midterms of our lifetime. Ballots have already started to be sent out. The threats to free and fair elections are real and growing more serious by the day.

What once seemed like an abstract threat has now become concrete. The risk of a rigged election is no longer unthinkable. The need for action can no longer be delayed or denied.

I have often said that Donald Trump’s plan is to make it harder for you to vote and easier for him to cheat. Now we know what that will look like in 2026.

Donald Trump issued an executive order claiming powers over federal elections that he does not have. In response, the U.S. Postal Service is trying to ram through a rule that will make voting by mail more difficult while requiring states to turn over sensitive voter data.

The Postal Service has not been shy in making clear that it is taking these steps to allow federal law enforcement to conduct criminal investigations of alleged voter fraud.

That is not all the USPS has done to make voting more difficult. A series of smaller changes have resulted in slower mail service and delayed postmarks on envelopes. While these are not limited to returned ballots, the results have been devastating for those trying to vote by mail.

Amtrak has ruined my vacation, and I’m pissed.

For years, Amtrak has sold the California Rail Pass for $159. For the right kind of traveler and the right trip, it’s almost too good to be true. During a 21-day period, you can use the pass for seven days of nearly unlimited travel (four trips per day).

The pass includes these four train lines:

• Pacific Surfliner: San Diego to San Luis Obispo
• Gold Runner (my favorite): Bakersfield to Bay Area
• Capital Corridor: Bay Area
• Coast Starlight: Los Angeles to Dunsmuir

These trains are connected by a bunch of bus routes, which the pass covers. Two of these buses even take you into Nevada (Reno, Las Vegas) for no extra charge.

“It’s not a wave you can surf” or see but it will register on tidal instruments

Sea levels along the California coast are expected to rise by a foot as soon as late September, as El Niño-warmed tropical water pushes a slow-moving wave up the coast of North America.

The swell isn’t something seen crashing at a beach but a planetary-scale process known as a Kelvin wave that is triggered by changes in wind at the equator.

“It’s not a wave you can surf,” said Dillon Amaya, an assistant professor of marine science at North Carolina State University. “You’re not gonna be able to see it from your boat, but our instruments will see it as it passes by, like tide gages.”

The coastally-trapped Kelvin wave, as it’s called, originated along the equator and hit the South America coast before turning north at about 6 mph. It raised water levels about nine to 14 inches (relative to 1993-2025 averages) along the coast of Central America in late August. That surge will hit Cabo in late September and eventually reach San Francisco the first or second week of October.

A whistleblower claims in a new report that the U.S. Postal Service (USPS) defied a court order by moving forward with a “secretive, rushed” effort to implement President Donald Trump’s mail voting order, which is now mostly blocked.

The report, published Tuesday by Sen. Richard Blumenthal (D-Conn.), along with a letter sent by Blumenthal to Postmaster General David Steiner, warns that the hurried development of a data portal for states to upload the new mail ballot envelope designs and mail voter lists required by USPS’s rule carrying out Trump’s order risks disenfranchising millions this November.

“According to the whistleblower, USPS’s effort to develop and deploy the Portal has been ‘rushed,’ ‘risky and haphazard’ because leadership has demanded an impossible timeframe,” Blumenthal wrote. “In an effort to meet impossible deadlines, USPS has eliminated standard and needed testing, thereby creating substantial risk of a ‘catastrophic failure’ of the system that could ‘derail the midterm elections.’”

The allegations are serious. Nursing homes, the exact number is unclear, across California including San Diego County, have employees who wear Ray-Ban Meta AI glasses while on duty.   The glasses are being used to record unsuspecting residents, a possible violation of a number of privacy laws, including those which address a resident’s expectation of privacy.

In a recent report the California Advocates for Nursing Home Reform (CANHR), a statewide nonprofit 501 (c) (3) advocacy organization, says: with a simple voice command like “Meta start recording” a nursing home employee can  “capture the entirety of their day on video while simultaneously feeding that footage into the glasses’ AI companion.”

A resident’s most personal or private moments can be captured on video without them knowing. For the unknowing patient there is no clear indication a recording is in progress — just a small white light that can be easily covered, says the report.  The non-profit warns that “residents at several facilities across the state have reported staff, including nurses, wearing the glasses and refusing to remove them upon request. In some cases, staff have recorded video with the glasses in areas that contain residents’ protected health information without obtaining prior consent”.

They continue “Many residents may not even be aware of the technology and its capabilities. This is a direct erosion of patient trust.” They add “These glasses, in most instances, are not prescription, meaning there is no explicit need for the user to wear them for medical purposes.”

Nearly Impossible for Public to Participate in Last-Minute Legislative Procedure

On Sunday, August 30, a little after 3 p.m. the California State Assembly voted to support Senate Bill 344 (SB 344) and eliminate the public’s ability to challenge in court any unmitigated environmental impacts that may be caused by the Midway Rising project. The official vote was recorded as 72 Ayes, 2 Noes (Castillo and DeMaio) and 5 No Vote Recorded (Addis, Boerner, Connolly, Hart, Muratsuchi).

Shortly thereafter, the California State Senate followed suit and voted 39 to 0 to support SB 344.

It now goes to Governor Newsom for his signature or veto. He has until September 30 to do so.

SB 344 eliminated the public’s right to fully participate in the judicial system and shielded the City of San Diego from any legal challenges related to the California Environmental Quality Act (CEQA) documents for the project.

This legislation was driven, in large part, by the City of San Diego’s failure to prepare an adequate Environmental Impact Report for the Midway Rising project. The City of San Diego was sued in court and lost because of that failure.

The Supreme Court’s ruling on Monday allowing President Trump’s executive order on mail voting to go forward is stunningly insensitive to the context: Trump is trying to exercise control over elections when he has absolutely no authority to do so. In one sense, the justices decided nothing, simply saying it was too soon for federal courts to get involved. But in a more important way, the court could have and should have put an emphatic end to the president’s efforts to try to regulate voting operations that are legally the domain of state governments.

The context for the Supreme Court’s ruling is Trump’s repeated assertion that noncitizens are illegally voting in the United States. However, many studies done on this topic have come to the same conclusion: Instances of noncitizens voting are extremely rare.

One study from 2017, by the Brennan Center for Justice, looked at 42 jurisdictions across which more than 23.5 million votes were cast, and found only 30 instances in which there were investigations into noncitizens voting — or 0.0001% of ballots cast.
