Encanto and District 4 Residents Hope City Council Will Revoke Infamous ‘Footnote 7’ Today, Tuesday, Jan.28

A big turnout by Encanto, Chollas Valley and other District 4 homeowners, residents, business owners, and their city-wide supporters is expected at today’s San Diego City Council discussion and proposed action to nullify a deceptive exemption to city planning codes.They hope that today at 2 PM, the San Diego City Council will consider revoking the underhanded “Footnote 7”.

Footnote 7 rezoned large areas of Chollas Valley—including areas that were planned for parks—without going through the proper Community Plan Update process. This was deliberately deceptive.

The Planning Department has yet to explain why it was buried within a general Land Development Code Update, denying Chollas Valley residents the opportunity to negotiate community benefits.

The Planning Department and City Attorney assert that the removal of Footnote 7 should only apply to future projects. Given that the City has not explained how Footnote 7 originated, the City Council should apply the change to all projects—past and present.

This all happens today, Tuesday, January 28, at 2 PM, at City Council Chambers, 12th Floor, 202 C Street San Diego, CA 92101

Footnote 7 is Item 331, which is the last item on Tuesday’s agenda.

  1. Footnote 7 has been revoked and…….

    Councilmember Henry Foster made the motion to not only repeal Footnote 7, but also to ask City Planning to REMOVE the Bonus ADU Program so that the program is consistent with state-mandated ADU regulations. This was seconded by Councilmember Raul Campillo. The motion was passed unanimously.
