The San Diego Planning Commission is taking up the issue of the 20 units of the proposed ADU apartment for Point Loma Avenue in Ocean Beach.

Its 1225pm and it looks like the appeal of the project will be granted.

1224. The acting chair just said he would also support the motion to approve the appeal. Congratulated Craig Sherman.

1222pm another commissioner is on board with approving the appeal.i

12:20 Another commissioner sounds like he also agrees with the argument. He doesn’t want to approve something that would win on court appeal.

12:19pm – At least one commissioner agrees with the appeal historical district argument and makes a motion to grant the appeal.

12:12 Commissioners begin making comments and asking questions.

12:10pm public comments have concluded.

There aren’t too many in favor of the project.

1201 Rep from YIMBY Democrats who supports the project called the appeal “frivolous.”

12:00 Speakers continue to argue against the project and in favor of the appeal.

11 am; rep for applicant begins his presentation, making the point that the property is surrounded by multi-unit projects.

10:55 am Sherman argues that the property is in an historic district. Which is an exception to the Complete Communities policy.

10:50am Attorney Craig Sherman begins appellant’s argument, hammering on that they were denied documents relating to the decision to allow project to proceed;

10:37 am; staff completes its presentation and the hearing will move to presentations of the appeal and the applicant; taking a short break. Chair said they have 55 speaker slips.

10:28 am; basically staff have rejected all appeal issues.

10:05 am. Staff continues to argue against any “historic” designation of the property.

9:54 am; staff is now presenting the project; this is an appeal by the community of staff’s decision to allow the project.

9:50 am. They’re up and running but still have audio problems with the call-in comments.

9:40 am the meeting has been paused as staff tries to fix the audio on the livestreaming.

9:30 a.m. During the non-agenda comment period, two OB speakers criticized the 4591 Pescadero project for 8 units after numerous code violations, they said, and no permit.

  2. So far, I can see Geoff Page, Ray & Kathy Blavatt, Andrea Schlageter in the audience; also Craig Klein. Lots of white-haired people in the audience.

  3. The audience is full, the front rows are full. 55 speakers but actually more than that with online attendance. I am so impressed. GO OB.

  4. FWIW, for future projects, it is more impactful to have individual speakers say their piece at the hearing rather than ceding to a fairly rambling presentation. Cheers,

    1. I don’t think it was known that the applicant and appellant would be granted 10 minutes each. The city doesn’t normally do that. So a lot of people were there to cede time but it wasn’t really needed.

      I agree, anyone ceding time should have a backup comment of some sort in case their ceding is not needed.

  5. FYI, this is not an ADU project, it would be 20 apartment units, standard dwelling units.

    The ADU bonus program is a different deal, that is what’s being used for the 8-plexes going up in some backyards around south OB. Unfortunately those are no longer being sent to local planning boards for a public meeting.
    And the city is violating the code regarding the affordability component for those. I gave them the code in clear black and white but they kept on reciting city codes that are not certified by the coastal commission. This is one of many examples of the city violating of its duties in administering the Local Coastal Program. I don’t know what the recourse is, but there should be some from the Coastal Commission.

    DSD’s sloppiness in following development codes is one thing, but when they outright ignore issues pointed out to them, it’s gross negligence. And it’s wasting the time and resources of developers and the public, and is subjecting the city to litigation.
