Florida’s Republican Governor Rick Scott has decreed through executive order that drug tests will be mandatory for all state workers. Scott, a Tea Party-backed conservative, signed a bill last week requiring random drug screening for all workers on the state payroll, approximately 100,000 of them, at least once every three months. He also intends to make good on his campaign pledge to require drug tests for welfare recipients, another 58,000, who would be required to pay for their own drug screening. Wow. That’s harsh.

If the people had a do over, the newly elected Republican governors of Pennsylvania, Michigan, Ohio, Wisconsin, Maine and Florida would probably be consigned to the dust bin of history under the heading “buyer’s remorse.” That’s not how it works however. Florida got Rick Scott. Rick Scott managed to burnish his tarnished credentials stemming from his partnership in “the largest private for-profit health care company in the U.S. He was forced to resign as Chief Executive of Columbia/HCA in 1997 amid a scandal over the company’s business and Medicare billing practices; the company ultimately admitted to fourteen felonies and agreed to pay the federal government over $600 million.”

So even if you are a crook, being a billionaire crook and a Tea Party darling confers a certain amount of burnishing power. It is estimated that the drug testing for state employees at $35 a pee would add about 3.5 million dollars in costs to the state budget. Scott has begun the usual right wing slash and burn on that very budget. But here’s where it gets really really interesting. Enter Solantic, an urgent care clinic which Scott founded in 2001 and then transferred to a trust in his wife’s name when he became governor. Solantic advertises to employers “we now offer an out-of-state solution for your drug screening and blood alcohol testing needs.” He recently assured his constituents and the press after they raised a big stink that the state will not do business with Solantic.

That’s only partially true. According to the Palm Beach Post News “Solantic CEO Karen Bowling confirmed that her company had received $110,657 from the state in 2010 and $20,061 so far in 2011. She said Monday that those payments were for employment-related physicals and for workers compensation care for state employees of the Department of Transportation, the Department of Environmental Protection, the Department of Education and the Division of Vocational Rehabilitation.

They were not direct state contracts, but were via the state’s workers compensation benefits management company, she said. Solantic clinics also accept payments from some Medicaid HMO plans. Pending legislation will open the governmental spigot to many more payments to private companies for those Medicaid HMO plans and Solantic appears positioned to do quite well.

The ACLU has also taken an interest in the drug testing as a violation of 4th amendment protections against the intrusive reach of government – but only as it applies to public workers. Current laws define the parameters of drug testing as deriving from well documented reasonable suspicion or in those instances when the ingestion of drugs poses a threat to the public safety. The law also requires that an employee must be informed before testing. Scott doesn’t believe that the current law is adequate.

But I wonder why the 4th amendment doesn’t apply to people seeking or receiving welfare. Or why the current law, which seems reasonable, does not apply to the private sector. Readers – please tell me if your terms of employment include peeing in a cup and what you think about that. I’ve still been researching this. The drug testing for welfare recipients originally began as drug testing of drug offenders who apply for welfare. It morphed into something much more expansive and uglier. I also wondered about Scott’s “executive order” to require drug testing. That order nullifies or circumvents the collective bargaining agreement with state employees in terms of the conditions under which drug testing can be conducted. What that means is that unions become a key voice in determining drug testing policies in the workplace-unless there is an executive order (and no litigation). Unions are weak or non-existent in the private sector- hence no reasonable policies there. And of course welfare recipients have no union- although they could.

Because being poor is a crime in this country and criminals have no protection under the 4th amendment.

didnt this governor work for a company that provides drug tests? nice helping out friends.

he should be required to drug test if these workers and people on welfare have to also.

for a single mother on welfare with 2 kids, she HAS to look for jobs 20-40 hours a week for approx. $500 a month. this state has 12% unemployment rate. how can someone pay their rent on 500 dollars alone and then buy LIVING SUPPLIES and also pay for a drug test whenever. they are barely surviving.

It was outrageous that this man got elected with his background and his “cut govt.” politicking, and now to read that he wants to cost the govt. more by doing this and benefitting his family financially is abominal! Are Floridians getting mad now?
I sure hope so.

I wonder how the people that commented on this back in 2011 are feeling now.

Because here we all are 12 years later and the GOP who put in this corrupt right wing corporate wealthy extremist as governor is now a Senator from Floridiotland, Talk about not learning the lesson.

And then, if that wasn’t bad enough, as a replacement the GOP put in a new corrupt right wing extremist governor named DeSantis (nicknamed DeSatan) who is not as wealthy but just as much of a psychopath and maybe worse. And he’s at war with Disney while promising to “slit the throats” of anyone in government that he doesn’t like if he becomes president.

And it’s over a hundred degrees in the middle of winter in South America.

Ever watch the movie ‘Idiocracy?’ That explains Florida perfectly. De-evolution.

As fast as the climate is destabilizing, the ocean is overheating, and the Atlantic being the hottest on record we may see the first Category 6 or possibly a 7 ever recorded, too, this year. At least sometime soon, eh?

With the Florida Keys ocean temp at a record 101’F, like a hot tub, one must think about 200 to 300 mph winds. The Philippines’ 2013 Typhoon Haiyan recorded windspeeds at beach level of 195 mph with 25.5 feet of storm surge.

A 195mph is NOT a Category 5. It’s a 6. How about a Cat 7, anyone? 250mph? Of course expect to see storm surges up to 50 feet. Or more. The coast and far inland Florida will cease to exist. OSB board-built houses aren’t really much better than the 11 million that blew away in Hiayan, ya know?

And we ALL know what will happen. Senator Scott and Governor DeSantis will be DEMANDING federal disaster funds. Count on it. So they can rebuild next to the ocean on the sand that is still left.

And on top of all this, these kind of people STILL make people pee in a cup for a job or anything else even as state after state votes in medical or recreational cannabis. And Donald Trump who lived in Florida was put in by the GOP as President in 2016. The insanity of all this in 2023 is mind-blowing.
