Here at the OB Rag we don’t have an “editorial board” that noshes on smoked salmon and sips champagne while we sit around and make election recommendations. That’s not how we roll, unlike our dead tree brethren at the daily fishwrap, who have experienced yet another 7% decline in circulation over the past year, according to the Wall Street Journal. That’s my way of saying that the opinions expressed in this article are nobody’s but my own. And here they are…

Federal and State Elections

U.S. Senator: Karly Fiorina (R) vs Barbara Boxer (D, Incumbent)

Fiorina’s portrayal of the ailing US economy as somehow being the fault of the Democratic Party and the incumbent Senator conveniently forgets that the collapse was triggered by the wave of de-regulation supported by virtually all Republicans (and many Democrats). Her track record at HP (30,000 jobs shipped overseas) gives us no insight into how she will improve the economy for anybody but the already privileged. While Barbara Boxer’s record leaves much to be desired, she is clearly a better choice for California.

Governor: Meg Whitman (R) vs Jerry Brown (D)

Meg’s TV ad says it best: thirty years ago when she moved to California, anything was possible. And who was Governor at the time? Jerry Brown. Send Meg and her millions a message and vote for Jerry Brown, who is clearly a better choice.

Gavin NewsomLt. Governor: Abel Maldonado (R, Incumbent) vs Gavin Newsom (D)

While the position of Lt. Governor is largely ceremonial, it’s often used as a “place holder” for politicians who are interested in higher office. The incumbent has been referred to as a moderate Republican; the challenger has a track record on social justice issues as Mayor of San Francisco that makes him an easy choice.

Debra BowenSecretary of State: Debra Bowen (D, Incumbent) vs Damon Dunn (R)

By most accounts, Bowden, who was elected to the post in 2006, has done a superlative job of dragging California’s election machinery into the 21st century. Her opponent is an ex-football player with a history of not voting. (I wonder if that was a qualifier for the GOP this year.) Stay with the incumbent.

Kamala HarrisAttorney General: Steve Cooley (R) vs. Kamala Harris (D)

It’s Los Angeles vs. San Francisco here, with both candidates currently serving as DA in their respective cities.  Steve Cooley’s first move as LADA was to disband the environmental crimes unit; he is joined at the hip with SDDA Bonnie M. Dumanis in his zeal for prosecuting pot dispensaries. That’s a waste of taxpayer money in my opinion. Vote for Ms. Harris.

Tom TorlaksonSuperintendent of Public Instruction: Tom Torlakson (D) vs Larry Aceves (I)

California, which once had one of the country’s best public school systems, now ranks at or near the bottom on academic achievement and school funding. Both candidates for this post agree on this and many other issues. Torlakson has the endorsements of both the daily fishwrap and a boatload of unions, based on his years of experience in the political scene. Aceves, a former school administrator has his own boatload of endorsements, many from fellow school administrators. Torlakson’s experience gives him the edge here.

California Courts: Various Candidates

This one’s a toughie.  I’ve never heard of most of these folks.  California law allows voters to “throw judges out” via votes. There are no opposing candidates, so if a judge is voted out, the Governor appoints a replacement. Fortunately, the vast research department here the OB Rag (aka Google) has turned up a socially conservative website (JudgeVoter.Com) that gives us a means to gauge the candidates:

“Unfortunately, many judges sitting on California courts may be incompetent, corrupt, lazy or soft on crime.  Even worse, many are political opportunists who have a political agenda—they are “judicial activists”

I figure if they’re against them, I’m for them, and vice versa.  It’s not a perfect system, but it’ll do for now. Here’s the list that will be on your ballot, along with MY suggestions:

Statewide Ballot Propositions

After much personal debate (I don’t use the stuff), I came down in favor. My original piece, which was part of a multi-part series on why we get high, is the most heavily trafficked article in OB Rag history. See OB Rag articles: Here, Here & Here.

Proposition 20: Congressional Redistricting – YES

election prop 20 -27 buttonsThis initiative adds the districts for US House of Representatives to the reforms passed last year. The bottom line here is where or not we want the legislature drawing Congressional boundaries. I vote against the legislature, which in this case was a Yes vote. Here’s our coverage.

Proposition 21: Vehicle License Fee for Parks – YES

I love it when I can quote my own articles:

So it’s come down to this: either vote to add an $18 annual fee to your car registration or we’ll close the State of California’s 278 Parks. This reminds me of that old National Lampoon magazine that ran with the cover art of a gun pointing at a dog and the headline: “If You Don’t Buy This Magazine, We’ll Kill This Dog”.

Do you wanna really screw schools and other social services while lining the pockets of developers suckling on the teats of so-called Community Development Corporations? It’s welfare for the rich, and don’t let anybody tell you otherwise. Vote No on 22. Here’s our coverage.

Proposition 23: Suspend Pollution Control Laws- NO

Don’t Californians deserve Clean Air AND Good Jobs? Vote against the Texas oil companies.  Vote No on 23.  More here.

Proposition 24: Undo Arnold’s Giveaways to Corporations. – YES

The top 1% of businesses trading in California got a smokin’ good deal out of the budget negotiations for last year’s budget. They can afford it.  See this LA Times article for proof. Vote Yes on 24. Our take here.

Proposition 25: Majority Rules – YES

So we’ve had this rule on the books for three decades now requiring a 2/3 vote for the legislature to pass a budget. Have things gotten better? Nope. Even Meg Whitman pines for the old days. Wouldn’t keeping this rule fall under the definition of insanity?  Vote Yes on 25. Things aren’t gonna get any worse, that’s for sure. More here.

Proposition 26: Tobacco and Oil Companies Know What’s Best for Us – NO

Their concern for us little guys is soooo touching. I mean, really, who isn’t being crushed financially by “the hidden taxes on products and services that Californians use every day”? Say ‘No way, Jose” on Proposition 26. Our take.

Proposition 27: Politicians Are Our Friends, Really. – NO

This bit of lawmaking magic would have us overturn the reforms passed year that said ‘no thanks’ to the idea of the Legislature continuing to draw district lines for office holders. The new reforms haven’t even been tried yet, but the idea is so odious that we need to undo them. Dozens of hungry consultants are counting on your vote. I don’t think so. Vote No. Here’s our analysis.

Easy Frank, not a jab on the Rag. These California rebubikin candidates know how to look cool while being completely transparently false. Why they get away with it is rich people trump lifestyle. Now that she has bought a surfboard she can legitimately claim to have a platform.

I am of the opinion you are making an error in your recommendation of McConnell. I just filed a complaint with the California Commission on Judicial Performance against her yesterday (of which she chairs the committe), along with a request that District Attorney Dumanis investigate her for aiding insurer fraud on behalf of the affiliates of the US Chamber of Commerce; and adverse to public health and safety. Of course, one will not read of it in the Union Trib, but is not a pretty tale that has been playing out in the San Diego courts for five years, right under the noses of the good people of San Diego and California.

If you are concerned for workers rights, the environment, democracy and freedom of speech for the public good without fear of retribution from courts who favor the interests of the affiliates of the US Chamber of Commerce; you may want to reconsider your recommendation of Justice Judith McConnell after reading the below complaints to CA governing agencies and linked legal documents.

I’m urging a NO on 20, and YES on 27. I don’t love gerrymandering, and voting this way or that on these propositions won’t really eradicate the fundamental politics of redistricting. What I love even less is a small commission with a greater ratio of republicans on board than exists in the state they are carving up. Here’s a little info on the judges from Democrat Roland Bleu. Most of the votes are formalities. There is no opposition to almost all of these seats. I compiled this because people were asking and because I did not want to vote for a Republican unless I mostly agreed with their viewpoint (see Bedsworth, Moore & Monroy) even if it doesn’t change anything.

*Tani G. Cantil-Sakauye: worked for Deukmejian and was appointed to her first
bench by Pete Wilson. She was appointed to this position by Schwarzenegger. She
is Filipina and highly likely Republican and conservative. Only 3 Public
Defenders are listed on her long list of endorsements on the League of Women
Voters website. Lots and lots of DA’s endorse her. Public Defenders are FAR more
likely to be Democrats. I have no idea if a “no” vote has any meaning but the
courts are important. I think voting for her just because she’s a girl or Asian
is a mistake. The term is 12 years and the seat is Supreme Court Justice

*Ming W. Chin: position, Associate Justice of the Supreme Court. Asian male.
Again, a “no” vote may be meaningless as above. Appointed by Pete Wilson. Same
term length, 12 years

*Judith D. McConnell: Democrat. She went to Berkeley in the 60s and then to Boalt
Law School, started her career in San Diego. Appointed first by Jerry Brown to
the bench and then by Gray Davis. She’s one of ours.

*Carlos R. Moreno: Democrat

*Manuel Ramirez: Conservative. When he actually does do something, it’s very
conservative.

*Carol D. Codrington: Republican. graduated from Loyola. Loyola tends to crank
out conservative attorneys, but she did do disability rights. She’s out of
Riverside. Appt’d by Schwarzenegger

*David G Sills: Republican, appointed by Deukmejian, out of Orange County, former
member Republican State Central Committee

*William Bedsworth: Likely a Republican, appointed by Wilson, but he ran for
office before he was appointed. He wrote the appellate opinion protecting gays
and lesbians from being dismissed from juries because of sexual orientation.
First court ruling in the nation to prohibit discrimination against gays serving
on a jury. On the other side, he was a DA, and he hates the “knock and announce”
rule (1. knock and announce presence 2. advise occupants of purpose, usually,
“police we have a warrant” 3. request/demand entry and 4. give occupants
sufficient time to respond before forcing entry). Evidence gets destroyed and/or
the police did not execute knock and announce and so sometimes evidence can get
excluded. DAs & police hate this rule. But again, his legal idol is former
Justice William Douglas, described as one of the most flaming liberals on the
bench appointed by FDR. Bedsworth wrote one opinion in the format of the “Night
Before Christmas” Poem. He did go to Boalt in 1971, but his undergrad was at
Loyola (see above about Boalt and Loyola). He also likes country western music.
However, he does believe that citizens have a protected right to give each other
the finger. His judicial philosophy is to try very hard not to make law. So,
personally, I’m a big old YES vote for him.

*Richard Monroy: endorsed by Democratic friends, well respected; Also Monroy’s opponent, Jim Miller, says he would emulate Justice Scalia (Scalia thinks women’s rights and minority rights are not protected by the constitution and would even roll back school desegregation) . That alone gave Monroy my vote.

*Eileen C Moore: Graduated UC Irvine B.A., JD from Pepperdine. Pepperdine is a
religious school with mandatory religion classes. She is out of Orange County
appointed by Deukmejian originally and then by Gray Davis. She is known for her
civility in the courtroom and is very well-respected. Her focus is on better
response to and reduction of domestic violence for which she has been honored
twice by the Orange County Board of Supervisors. She was a combat nurse in
Vietnam and so is a Vietnam Vet. She lectures fairly extensively to law schools
and universities, mostly her alma maters, and has written a book on Civil
Procedure (for lawyers and law students). What I like most about her is that
when given the task of finding art for the new 4th District Courthouse in Orange
County she turned to junior high and high school students, including the
students in Juvenile Hall High School and had them create artwork in teams that
interpreted important cases that were decided by the 4th District. She
definitely leans to the right but she is an exemplary person.

This is an incorrect statement. Justice McConnell is not “one of ours” unless “we” are the US Chamber of Commerce. Perhaps you did not read my prior comment. I currently have a request into DA Dumanis to investigate McConnell for aiding and abetting insurer fraud by failing to stop strategic litigation carried out by criminal means by an author of “environmental” policy for the US Chamber. Maybe she used to be one of ours; but from what I have witnessed, she has become quite a political animal with reckless disregard for public health and safety – and for protecting Democracy over the interests of commerce.

THIS IS WHAT IT IS ALL ABOUT:

Agnotology is the study of culturally induced ignorance or doubt, particularly the publication of inaccurate or misleading scientific data. When misleading scientific data is allowed to be applied to establish health policies for the purpose of instilling bias in the courts to cause more favorable financial outcomes and unfair advantage for insurers, employers and other financial stakeholders of moldy buildings, it then becomes insurance fraud. When judicuaries repeatedly ignore irrefutable evidence that strategic litigation against public participation has been occurring in their courts and has been carried out by criminal means to silence, punish, discredit and financially cripple one who has been willing to speak against the insurer fraud and expose the devastating impact it is having on US citizens with the involvement of the US Chamber of Commerce; it indicates that the courts have either a.) become so serverly biased by the misinfomation marketed to them by the US Chamber et al, that they cannot look at the facts of a case with clear eyes; or b.) they have succumbed to political pressure and the whims of the monied to the point that justice for average citizens is no longer attainable in the California judicial system.”

Don’t be fooled by what you read in mainstream media. Look behind the scenes.

Unless “ours” are against protecting democracy & the First Amendment of the Constitution; against protection of health and safety of the public; and against stopping insurers from being able to shift costs of worker injury onto taxpayers via disability funds; McConnell is NOT “one of ours”.

She is bad news and I can PROVE it through legal documents.

As a lifelong democrat, I wanted to point out that you are wrong in your assessment of presiding justice manual Ramirez. You should have a yes next to his name. He is a moderate and a fantastic justice.
