Summer Lays OB Flat – Tourists Rule

There is nothing going on this week other than what we reported on last week. It’s summer. Tourists still rule the beach on the weekends, locals during the week.  Tourists will rule until Labor Day – after which local residents take back the beach … and the streets.

The OB Rag staff had a wonderful meeting last night. We discussed how we are moving in the direction of taking ads, of responding more to the budding music scene in OB, and of really needing a desk or small office space in OB’s business area, (and of course much more).

But if anyone knows of some space we could plop down in or at, to help us have a more visible presence in the commercial district, please, please let us know. We are asking you the reader for help here.

We also are ordering more T-shirts from the JamesGang – these will be black.

More later …

Okay, my fellow OBcean, we need your assistance. My son was detained and arrested for “curfew” violation and brought home in handcuffs at 1:30ish a.m about a month or so ago. We need a legal leg to stand on when we go to court on August 27th. I am willing to fight for my son’s (along with all minor’s) rights afforded to adults by the constitution. I feel his right to ‘peacefully assemble’ and his right ‘against unreasonable…seizures’ are being violated by the current curfew laws being enforced here in OB. We need some help creating a clear and legal defense. It’s all such legal mumbo jumbo, we’re not sure which way to go here.

It was my understanding that the curfew laws in San Diego (Municipal Code 58.0101, 58.0102, and 58.0103) were reversed in June, 97, in the U.S. 9th District Court of Appeals making enforcement of the current curfew laws null and void (go to this site for complete court documents… http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?court=9th&navby=case&no=9655290).

“Curfews are in violation, it appears, of both the First and Fourth Amendments to the Constitution contained within the Bill of Rights.” from http://www.curfew.org/fight/text/faq/

The First Amendment states that “Congress shall make no law respecting the right of the people peaceably to assemble.” Translated into modern language, it says that “No laws can be passed that say that people can’t hang out together.”

The Fourth Amendment reads: “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated.”

Now, we were told, local law enforcement has made up a new set of laws in June, 02, (http://docs.sandiego.gov/municode/MuniCodeChapter05/Ch05Art08Division01.pdf) and are no longer are clear as to how to present our best defense of “not guilty.”

Sure could use your help. Anyone else had this happen to their minor child recently? We sure are looking forward to fighting for our rights!!!

I checked out your link on curfews and cannot tell where it’s from, who wrote it or even if it is about California law, which of course applies to your son’s case. I’ve worked in juvenile court before, and juveniles do NOT have the same legal rights as adults. All you have to do is go to that court and you will see that.

Frank, I was surfing the web trying to come with something (anything really) to make our defense. I have all the links saved on my computer, yet there is so much information out there, it’s all getting very confusing. What a cartload of crap this all is to try and wade through. Got your e-mail, let’s chat one on one from there.

okay, you landlubbers – i’ll take the bait:

as president obama gets ready to dump the public option in this so-called health care reform debate – i say ‘where’s the debate?’ the most i’ve heard is about these disruptions at the debates. everybody i ask wants either the public option or some kind of universal health care. why are the insurance companies so involved?

according to rachel maddow, the day after obama started talking about dumping the public option, even though the rest of wall street tanked for the day, health insurance companies made off like bandits, pulling in the profits.

so, it gets down to this: we are one of the last industrialized countries without a government-sponsored health care program. the rightists call it ‘socialism’ but everybody in europe already has it. this is criminal. half of our country goes without.

Are europe and socialism antonyms?

Reply

Molly August 18, 2009 at 4:16 pm

Brian. Opposites – no, why do you ask? One finds that politics in Europe (and Canada) are so much more open. Socialists run open campaigns – and win! The head of France a few years ago was a Socialist. Imagine that!

No one would call France or England or Canada socialist nations, but their health care systems are so much more advanced than ours. Why?

(Howdy, I received this as an e-mail but thought it might be a good idea to post it here too. Have a great weekend!)

Because of recent abductions in daylight hours, refresh yourself of these things to do in an emergency situation. This is for you, and for you to share with your spouse, your children, everyone you know. After reading these 10 crucial tips, (you may have heard of the other tips, but #10 is a new one) forward them to someone you care about. It never hurts to be careful in this crazy world we live in.

1.. Tip from Tae Kwon Do : The elbow is the strongest point on your body. If you are close enough to use it, do!

2.. Learned this from a tourist guide. If a robber asks for your wallet and/or purse, DO NOT HAND IT TO HIM. Toss it away from you…Chances are that he is more interested in your wallet and/or purse than you, and he will go for the wallet/purse. RUN LIKE MAD IN THE OTHER DIRECTION!

3. If you are ever thrown into the trunk of a car, kick out the back tail lights and stick your arm out the hole and start waving like crazy…the driver won’t see you, but everybody else will. This has saved lives.

4. Women have a tendency to get into their cars after shopping, eating, working, etc., and just sit (doing their check book, or making a list, etc. DON’T DO THIS!) The predator will be watching you, and this is the perfect opportunity for him to get in on the passenger side, put a gun to your head, and tell you where to go. AS SOON AS YOU GET INTO YOUR CAR, LOCK THE DOORS AND LEAVE. If someone is in the car with a gun to your head DO NOT DRIVE OFF, Repeat: DO NOT DRIVE OFF! Instead gun the engine and speed into anything, wrecking the car. Your Air Bag will save you. If the person is in the back seat they will get the worst of it. As soon as the car crashes bail out and run. It is better than having them find your body in a remote location.

5. A few notes about getting into your car in a parking lot, or parking garage:

A.) Be aware: look around you, look into your car, at the passenger side floor, and in the back seat

B.) If you are parked next to a big van, enter your car from the passenger door. Most serial killers attack their victims by pulling them into their vans while the women are attempting to get into their cars..

C.) Look at the car parked on the driver’s side of your vehicle, and the passenger side. If a male is sitting alone in the seat nearest your car, you may want to walk back into the mall, or work, and get a guard/policeman to walk you back out.

IT IS ALWAYS BETTER TO BE SAFE THAN SORRY. (And better paranoid than dead.)

6. ALWAYS take the elevator instead of the stairs. Stairwells are horrible places to be alone and the perfect crime spot. This is especially true at NIGHT!

7. If the predator has a gun and you are not under his control, ALWAYS RUN! The predator will only hit you (a running target) 4 in 100 times; and even then, it most likely WILL NOT be a vital organ. RUN, Preferably in a zig -zag pattern!

8. As women, we are always trying to be sympathetic: STOP! It may get you raped, or killed. Ted Bundy, the serial killer, was a good-looking, well educated man, who ALWAYS played on the sympathies of unsuspecting women. He walked with a cane, or a limp, and often asked ‘for help’ into his vehicle or with his vehicle, which is when he abducted
his next victim.

9. Another Safety Point: Someone just told me that her friend heard a crying baby on her porch the night before last, and she called the police because it was late and she thought it was weird. The police told her, “Whatever you do, DO NOT open the door”. The lady then said that it sounded like the baby had crawled near a window, and she was worried that it would crawl to the street and get run over. The policeman said, “We already have a unit on the way, whatever you do, DO NOT open the door.” He told her that they think a serial killer has a baby’s cry recorded and uses it to coax women out of their homes thinking that someone dropped off a baby.. He said they have not verified it, but have had several calls by women saying that they hear baby’s cries outside their doors when they’re home alone at night.

10. Water scam!

If you wake up in the middle of the night to hear all your taps outside running or what you think is a burst pipe, DO NOT GO OUT TO INVESTIGATE! These people turn on all your outside taps full ball so that you will go out to investigate and then attack. Stay alert, keep safe, and look out for your neighbors!

Please pass this on. This e-mail should probably be taken seriously because the Crying Baby Theory was mentioned on America ‘s Most Wanted when they profiled the serial killer in Louisiana. I’d like you to forward this to all the women you know. It may save a life. A candle is not dimmed by lighting another candle. I was going to send this to the ladies only, but guys, if you love your mothers, wives, sisters, daughters, etc., you may want to pass it onto them, as well. Send this to any woman you know that may need to be reminded that the world we live in has a lot of crazies in it and it’s better to be safe than sorry….

Dave, I know you didn’t write this, but WTF?
what do you -since you forwarded it to us – mean there’s an increase in daylight hours abductions??!! Crime is going down. There’s nothing to suggest around San Diego that there’s an increase.

I’m afraid that even though many of these points are commonsensical, they in total make me more paranoid than I need to be. I take the stairs often for exercise. I look out for my fellow human. This list instructs me to ignore anyone who looks / is needy. My god, dude. Think on this. This list wants people to be shut up, locked up, and scared (kind of reminds me of the Bushies on a national level) – and it’s not very humane.

Dave Gilbert August 21, 2009 at 3:41 pm

Sorry Molly,

It wasn’t my intention to make people more paranoid but rather more aware. There are a lot of unstable folks around these days, so it was more of a word to the wise than words to hide from the world.

I too take the stairs because it’s great exercise and I don’t plan on stopping. But most of this stuff never even crossed my mind and I thought it should be passed on.

@Molly

I found this sentence curious:

“the rightists call it ’socialism’ but everybody in europe already has it.”

Where “it” referred to government-sponsored healthcare. I’m not sure what one half of the sentence has to do with the other. It almost seems to imply that if Europe embraced a program or concept, then it was, by definition not socialist in nature.

Your reply seems to reinforce what I already believed: that socialist ideas (and people, apparently) are from time to time embraced in Europe.

Reply

Molly August 21, 2009 at 4:45 pm

Okay Dave, but more aware of “a lot of unstable folks around these days” – what do you know that the rest of us don’t? I mean, where do you get off in saying there’s more unstable folks around now? what and where’s your proof? are you personally experiencing more unstable people in and or around your life these days?

My point: why raise the fear factor if you don’t need to. You and the emailer don’t make a case to raise it.

Reply

Molly August 21, 2009 at 4:49 pm

Brian, I believe my point was that the rightists call government-sponsored health care “socialism” even though most of Europe already has gov’t sponsored healthcare and they are NOT socialist societies. Sure, European politics are more balanced than ours.

Also, Brian, how about you actually reading The Communist Manifesto before you start slinging around terms that are not grounded in your experience/ knowledge? Even Henry Kissinger read it. Most intellectuals have also.

Reply

Brian August 21, 2009 at 4:50 pm

It wasn’t even your point. I was responding to a bodysurferbob post. Unless you’re the same person.

I’m not sure what I said that warranted a personal attack on my literacy.

Dave Gilbert August 21, 2009 at 7:03 pm

Molly, I’m not going to get into an argument with you on this blog. If you want to believe that everyone in this world means you no harm then by all means do so.

I thought it was interesting enough to post as there were things in there I’d never heard of, plain and simple. Perhaps someone else reading it will actually get something out of it, sorry you didn’t.
